U.S. Tax Operations, Withholding & Information Reporting – Associate Director
BTG Pactual, Latin America's leading investment bank, is seeking a U.S. Tax Operations & Compliance Associate Director to join our New York team, supporting BTG Pactual, N.A. and affiliated U.S. entities. This is a unique opportunity to own the operational tax framework — client tax documentation, withholding configuration and information reporting — of a global financial institution serving both U.S. (W-9) and non-U.S. (W-8) clients.
In this role, you will be responsible for the bank's tax reporting and withholding lifecycle: validating client tax documentation, defining and configuring product-level withholding parameters in the bank's systems, reviewing the preparation and filing of Forms 1099 and 1042/1042-S, and ensuring FATCA and CRS reporting obligations are met. You will also support U.S. federal, state and local tax compliance, including partnership compliance, and partner closely with Operations, Onboarding/KYC, Finance, Legal, Technology and the business units.
Key Responsibilities:
- Define the withholding rules applicable to each product and each client segment — interest (including portfolio interest and bank deposit interest), dividends and dividend equivalents (§871(m)), substitute payments on securities lending, PTP/partnership distributions (§1441/§1442, §1446(a) and §1446(f)), gross proceeds, FIRPTA (§1445), original issue discount, and payments to intermediaries and disregarded entities.
- Support the IT team on the configuration and maintenance of withholding parameters in the bank's core, custody and payments platforms: income codes, exemption codes, statutory vs. treaty rates, 30% NRA withholding, backup withholding at 24% (§3406), presumption rules where documentation is missing or invalid, and cascading/multi-layer withholding logic.
- Own the change-control process for withholding logic: business requirements, test cases, UAT sign-off, regression testing after tax law or rate changes, and documented rationale for every parameter.
- Reconcile amounts withheld to amounts deposited (Form 1042 / Form 945 / EFTPS) and manage under- and over-withholding remediation, including reimbursement and set-off procedures.
- Review and validate Forms W-9 and the W-8 series (W-8BEN, W-8BEN-E, W-8IMY, W-8ECI, W-8EXP), including withholding statements and allocation schedules for intermediaries and flow-through entities.
- Determine Chapter 4 status (Reporting FI, Deemed-Compliant FI, Active vs. Passive NFFE) and apply look-through to controlling persons of passive entities.
- Perform U.S. indicia searches and CRS residency determinations, manage curing of indicia, GIIN/TIN validation, and documentation validity/expiration and change-in-circumstances monitoring.
- Assess treaty claims and limitation-on-benefits eligibility, and apply reduced treaty rates on a product-by-product basis.
- Review the preparation and filing of Forms 1099 (1099-INT, -DIV, -B, -MISC, -NEC, -OID, -R as applicable), 1042 and 1042-S, Forms 8966 (FATCA), CRS returns, Form 945, and applicable state reporting.
- Manage the annual reporting calendar, recipient statement delivery, corrections/amendments, extensions, IRS TIN matching, and B-notice / C-notice and penalty-abatement processes.
- Oversee outsourced/vendor reporting providers and validate their output before filing.
- Support U.S. federal, state and local tax compliance, including partnership compliance (returns, K-1 allocations, capital accounts) and multi-state filings.
- Strengthen internal controls, risk assessments, procedure documentation, Form 1042 / 8966 audit readiness, and support IRS or QI-type examinations and any responsible-officer certification requirements.
- Drive process improvement and tax technology adoption (documentation validation tools, withholding engines, reporting platforms, data quality controls).
- Partner with internal stakeholders and external advisors and service providers.

Required Qualifications
- Bachelor's degree in Accounting, Taxation, Finance or a related field (CPA / JD / LLM preferred).
- 4–7+ years of progressive experience in U.S. tax operations or compliance, in a bank.
- Proven ability to work autonomously and manage stakeholders.
- Demonstrated, hands-on expertise in U.S. withholding and information reporting
- Proven ability to validate W-8 and W-9 documentation and translate the resulting client/product matrix into system withholding parameters.
- Working knowledge of FATCA and CRS, including IGA Models 1 and 2, entity classification and due-diligence requirements.
- Excellent analytical skills and attention to detail.
Preferred Knowledge and Experience
- Experience in U.S. banking, custody, private banking or broker-dealer environments, or at a global financial institution.
- Experience with Qualified Intermediary (QI) / QDD regimes and Section 305(c) / 871(m) operational requirements.
- Familiarity with tax and reporting systems and withholding engines.
- Strong communication and stakeholder management abilities; comfortable explaining withholding outcomes to front-office and to clients.
- Project management and process improvement experience.
- Spanish and/or Portuguese is a plus, given our Latin American client base.
- Experience with U.S. corporate and partnership federal and state tax compliance will be a plus.
